FTC Settles Charges That Payday Loan Tossed Sensitive Consumer ...

A company that provides management services to more than 300 payday loan and check cashing stores, and an affiliated company that owns and operates several stores, will pay $101,500 to?settle Federal Trade Commission charges?that they violated federal law by allowing sensitive consumer information to be tossed into trash dumpsters.

The Commission vote to approve the proposed consent decree was 5-0. ?The Department of Justice filed the proposed consent decree on behalf of the Commission, which was signed by the Judge Joan Gottschall of the U.S. District Court for the Northern District of Illinois?on November 1, 2012.

It has always seemed to me that that the practices of payday loan and check cashing stories are nearly predatory to begin with. That those who need money so badly that they are willing to pay what I consider exorbitant rates have to also worry about their identities is truly a sad statement. $101,500 just doesn?t seem an adequate penalty given the careless and reckless disregard involved here.

The FTC charged that PLS Financial Services, Inc., and The Payday Loan Store of Illinois, Inc., failed to take reasonable measures to protect consumer information, resulting in the disposal of documents containing sensitive personal identifying information ? including Social Security numbers, employment information, loan applications, bank account information, and credit reports ? in unsecured dumpsters near several PLS Loan Stores or PLS Check Cashers locations.? PLS Group, Inc., which owns PLS Financial Services and The Payday Loan Store of Illinois, was also named in the complaint.

The defendants are jointly and severally liable for paying the $101,500 settlement, which means that the total fine for all three companies was $101,500 and any one may pay that amount to satisfy the settlement. Such a paltry sum seems extremely out of line given the reckless and careless disregard for the privacy of their customers. Exactly who would think that it is a good idea to simply throw away sensitive, personally identifiable information that would give identity thieves everything they need to steal someone?s identity?

Identity theft is growing at alarming rates, and this story is one example as to why. It seems no one, including the FTC, takes identify theft seriously. These criminals are rarely caught it seems and the penalties for the criminals and the companies that are recklessly complicit and enable the crime are miniscule.

Typically identity theft is a criminal concern and not an intellectual property concern, but stealing someone?s identity is really akin to many intellectual property violations, which is why from time to time I do write about the topic.

The nature of identity theft is similar to infringement of the?right of publicity, and also similar to other intellectual property wrongs in that what is being taken is not a tangible piece of property, but information that is then used to deceive and fraud. Your number 1 asset is your good name, as is a trademark or trade name to a business. ?History teaches us that once a trademark has been sullied for one reason or another, whether by scandal, malfeasance or negligence, it is not easy to right the ship.

For example, so many years ago Tylenol was the subject of tampering, which caused the drug to be taken off the shelves and ultimately lead to all the safety precautions on over the counter medicine. ?But people died and despite the fact that Tylenol wrote the book on how to properly manage such an incident people of a certain age will still associate Tylenol to some extent with that tragic series of events. What this means is that prevention is the key to keeping a good name, both for businesses but also for individuals.

The fact that there is so much at stake and that it can take so long to rectify losses when an identity is stolen makes it all the more difficult to understand how and why the FTC simply slapped these payday loan companies on the wrist.

According to the?complaint filed by the FTC, PLS Financial Services and The Payday Loan Store of Illinois violated the FTC?s Disposal Rule?by failing to take reasonable steps to protect against unauthorized access to consumer information in the disposal of credit reports.? They also allegedly violated the Gramm-Leach-Bliley Safeguards Rule and Privacy Rule, which require financial institutions to develop and use safeguards to protect consumer information, and deliver privacy notices to consumers. ?Further, the FTC charged that all three defendants violated the FTC Act by misrepresenting that they had implemented reasonable measures to protect sensitive consumer information.

According to the FTC complaint, PLS Group owns approximately two dozen operating companies, such as The Payday Loan Store of Illinois, that in turn own and operate more than 300 retail stores in nine states under the names PLS Loan Stores and PLS Check Cashers.? These stores offer a variety of products and services, including payday loans, check cashing, automobile title loans, debit cards, phone cards, and notary services.? PLS Financial Services provides management services to the PLS Loan Stores and PLS Check Cashers locations, including establishing their policies and procedures for the handling and disposal of consumer financial information.

In addition to the $101,500 civil penalty imposed on PLS Financial Services and the Payday Loan Store of Illinois for violation of the Disposal Rule, the settlement bars all of the companies from violating the Disposal, Safeguards and Privacy Rules and from misrepresenting the extent to which they maintain and protect the privacy and integrity of personal information.

The Settlement also orders the defendants to ?establish and implement, and thereafter maintain, a comprehensive information security program that is designed to protect the security, confidentiality, and integrity of personal information collected form or about consumers.? The fact that this has to be ?ordered? is truly sad. Yet something tells me that these companies that offer these payday loans will continue to see business.

The order also requires that the companies implement and maintain a data security program with independent third-party audits every other year for the next 20 years.? It also contains certain bookkeeping and record keeping provisions to allow the Commission to monitor compliance with its order.

While I think this case represents a woefully inadequate penalty, the FTC does have very good Identity Theft Resources on their website. If the issue of identity theft worries you take a look at these resources.

China's inflation eases, giving room for stimulus

(AP) ? China's inflation eased further in October as increases in food prices slowed, giving Beijing room to launch new stimulus measures if needed to speed a recovery from a painful economic slump.

Consumer prices rose 1.7 percent, down from the previous month's 1.9 percent, the government reported Friday. Food prices rose 1.8 percent, down from September's 2.5 percent.

Lower inflation gives Beijing more room to cut interest rates or promote new stimulus measures to speed an economic recovery that appears to be taking shape. Forecasters say growth that has declined steadily over the past year should rebound this quarter or early in 2013 but any recovery is likely to be gradual and weak.

Chinese economic growth fell to a three and a half year low of 7.4 percent in the quarter ending in September but investment, retail sales and other indicators improved from the previous quarter. The government said last month it saw "steady economic growth," suggesting there was no need for further major stimulus.

Beijing launched a mini-stimulus, cutting interest rates twice in June and July and stepping up investment by state companies and spending on building airports and other public works. But authorities avoided bigger measures after their huge spending in response to the 2008 global crisis fueled inflation and a wasteful building boom.

Communist leaders spent two years trying to crush inflation and prevent economic overheating but shifted emphasis late last year to shoring up slowing growth after global demand for Chinese exports plunged.

(AP) ? President Barack Obama's re-election has left Israel's prime minister in a bind.

Benjamin Netanyahu repeatedly has clashed with Obama and was widely seen as backing Republican challenger Mitt Romney in the American election. Yet in the coming months, Netanyahu will need American support more than ever as the Palestinians seek upgraded recognition at the U.N. and the world grapples with the Iranian nuclear program.

"It seems like it is not such a good morning for Prime Minister Benjamin Netanyahu," Israeli Cabinet minister Eli Yishai told reporters early Wednesday as news of Obama's victory emerged.

The concern reflected the widespread perception in Israel that poor personal chemistry between the two leaders could affect the broader relationship between their governments, particularly if Netanyahu is re-elected in upcoming parliamentary elections. The Israeli leader is the front-runner in the Jan. 22 race, according to opinion polls.

The chilly relations are a result of style and substance. The two men have vastly different world views ? Netanyahu's hawkish positions on security and support for free-market capitalism are much more in line with the Republicans ? and they have never appeared comfortable with one another.

In one tense encounter, Netanyahu appeared to lecture Obama on the pitfalls of peacemaking as they sat in front of reporters in the Oval Office. During that same trip to Washington, Netanyahu was warmly welcomed in a speech on Capitol Hill, creating a perception that he was playing off Congress against the president.

They have also clashed over key policy issues. Obama took office promising to make Mideast peace a top priority, and he quickly alienated many Israelis with his outreach to the Muslim world. Israelis remember Obama's decision not to visit the country after making a landmark speech in neighboring Egypt shortly after taking office.

Obama pressed Israel to end settlement construction in occupied territory claimed by the Palestinians. Netanyahu, a longtime supporter of the settlers, agreed to a limited freeze on construction. But when the slowdown expired, he refused Obama's appeals to extend it. Peace talks quickly broke down, and Palestinians, disillusioned with Obama, have refused to return to the negotiating table.

Differences over Iran have been equally stark. Both countries suspect that Iran is developing a nuclear weapon ? a charge Tehran denies. But their approaches to resolving the matter are vastly different.

Obama has pushed for a diplomatic solution and spearheaded international efforts to impose a series of punishing economic sanctions on Iran.

Netanyahu, believing a nuclear-armed Iran would threaten Israel's very existence, has expressed skepticism over diplomatic efforts and threatened to attack if necessary.

These threats are not empty. Earlier this week, an Israeli news program reported that Netanyahu had put Israel's air force on high alert for a possible attack in 2010 but backed down following objections by his security chiefs. Speaking to the program, Netanyahu said his resolve to attack, if necessary, remains firm.

Disagreements over the military option spilled over in September when Netanyahu urged the president to spell out clear "red lines" that would trigger an American attack on Iran. Obama refused.

The dispute, coupled with Netanyahu's decades-old friendship with Romney and American casino billionaire Sheldon Adelson, a bankroller of Romney's campaign, added to the perception that the Israeli leader was siding with the Republican challenger.

"I think that a prime minister in Israel doesn't do two things. He doesn't interfere in the elections in the U.S. and he doesn't gamble on one of the candidates. This definitely caused damage," opposition leader Shaul Mofaz told Channel 2 TV.

Netanyahu, who has denied taking sides in the U.S. race, quickly congratulated Obama on Wednesday and described the security relationship between the two countries as "rock solid."

"I look forward to working with President Obama to further strengthen this relationship and I look forward to working with him to advance our goals of peace and security," Netanyahu said at a joint appearance with U.S. Ambassador Dan Shapiro.

Shapiro, meanwhile, dismissed suggestions that Obama might seek revenge as "ridiculous." Obama is "not somebody whose policies are governed by emotions," Shapiro told an academic conference.

Relations could be tested as soon as this month when the Palestinians are expected to ask the U.N. General Assembly to grant them upgraded "nonmember state" status. The Palestinians are seeking broader international backing for their independence in the absence of peace talks.

Israel staunchly opposes the bid, saying differences can only be resolved through negotiations. While the U.S. also opposes the Palestinian initiative, Obama may push Israel to make some concessions to the Palestinians in order to halt the bid and return to negotiations.

"We hope that President Obama's second term will be a term for peace, stability and democracy for the region, during which we will witness the implementation of the two-state solution, the end of Israeli occupation and the establishment of a Palestinian state," Palestinian negotiator Saeb Erekat said.

The Obama victory could also play a role in the Israeli election campaign.

Eytan Gilboa, a political scientist at Bar-Ilan University, said Obama could hypothetically side against Netanyahu in the Israeli campaign by signaling support for opposition leaders, though he said Obama would be "ill advised" to do so. More likely, he said opposition leaders would try to make the rocky relationship with the U.S. a key issue during the campaign.

Gilboa said the Obama reaction might even draw heavyweight opponents like former prime minister Ehud Olmert back into the race.

In a speech to American Jewish leaders in New York on Wednesday, Olmert, in a possible prelude to a political return, accused Netanyahu of damaging relations with the U.S. "Following what Netanyahu did in the last few months, raises the question whether or not our prime minister has a friend in the White House," Olmert said, accordingly to a statement from his aide.

"I am not sure of that, and it could be very significant for us at a critical time," he said. "To my great distress, Netanyahu has turned Israel from an issue that is above all dispute in the American campaign to an issue at the heart of the debate."

The biggest challenge for U.S.-Israeli relations could be Iran. In his speech to the United Nations General Assembly, Netanyahu said the window to attack Iran was quickly closing, and the world would have to act by next summer at the latest. With Obama expected to step up his diplomatic efforts, perhaps even through direct talks with Iran, tensions could emerge if Netanyahu is re-elected.

Aaron David Miller, a former Mideast negotiator under Republican and Democratic presidents, said he did not think Obama "will go to war" with Netanyahu. But he said he did not think the personal relationship will improve unless the men are "forced by necessity" to cooperate, perhaps by resolving the Iran issue.

"In general, you have a relationship that doesn't have a solid foundation. There's great distrust," he said. "But regardless of a lack of trust, in a way, the relationship is too big to fail."
